Snow coverA question I meant to ask last year but seeing as we're all hoping for snow now seems like the right time.
What happens if somebody's car gets damaged whilst we're helping them out of a predicament? I know the example below just goes to show how stupid people can be but would we be liable??? ![]() -----------MUD SLUT ~ hitting every hole ~----------
Re: Snow coverLMAO ! dingbats..........
Re: Snow coverMrTom,In my opinion if anyone asks to be pulled out of a predicament in the snow then I think they would be liable but I could be wrong. It would be at their own risk in my opinion. What I tell people is not to try and drive themselfs out while Im pulling them out of the snow just incase they get some grip,so they dont run into the rear end of me.

Re: Snow coverI agree with you mate but in this day and age you get penalized / sued lefty right and centre for anything. Wouldn't surprise me if someone went for the old whiplash claim whilst they were being helped out haha

Re: Snow coverI'll just stick to what I've always thought...............................If in doubt, don't do it.
Don't think I'll be helping anyone this year, to many folks around my way that'll expect it everytime.

Re: Snow coverMy 4x4 Insurance covers me for this,it cost me an extra £30 so I am covered
But if some think dose happen like the vid above and they claim against me, I still have to pay an £50 access But if I was pulling some out like I did last year, I always say I will not take any liability for any damage when getting them un stuck
Re: Snow coverJason, thats a good way of not being liable by saying:- "I will not take any liability for any damage when getting them un-stuck."

Re: Snow coverI was always told that i should never touch the other persons car, they should always attach the rope themselves and that i should say
'ill try to get you out but cant guarantee i can or that no damage will happen to your car, is this ok with you?' most people say yes thats fine, i only ever had 1 guy say no its all my responsibility so i told him to call a tow truck i am always weary of offering help to 'chavs' etc only due to all kids want easy money now so they will try any way possible. when i put the truck in the 'ditch' last year it cost me £40 to get it winched out, gotta admit i wouldnt have thought to charge If it ain't broke, fix it before it does!! You know it will!!
Re: Snow coverLike I said I would never charge (where's the spirit in that). As sad as it sounds I might carry a load of photocopied disclaimers in the glove box and just get them to sign and date it if they need a tow.

Re: Snow coverOnce you're hitched up to the stuck motor you are basically the tractor unit towing a trailer so could be liable for wherever the "trailer" ends up. If the "trailer" becomes driven, then that could change things.
If in the habit of towing folk out it maybe worthwhile setting up cameras to video each operation. Just a thought. Kodiak Transglobe 2.0 SWB

Re: Snow coverI find it sad I have even asked about this as it goes to show how bad it's become. I like the idea of visual proof but if I get them to sign something it's all on them no questions then even if I do damage something. ( unlikely seeing as my 2.0l can't pull the skin off a rice pudding )
