Driver with 39 points on licence not banned
A Freedom of Information request to the Driver and Vehicle Licensing Agency (DVLA) revealed that, as of 24 March 2011, 638 drivers have 12 or more penalty points on their licence, yet they are still on the road.
According to the BBC, the worst offender is a driver registered in Swindon, who has amassed an incredible 39 points, yet has not been banned from driving. No information regarding the type of offences committed was available.
Elliot Griffiths, from the Magistrates' Association, said: "I accept that something appears to be wrong with [the figures in the Swindon case] and they need to be looked at.
"I can't even conceive how somebody can have 20, 30, 40 points and not be disqualified.
"I can't work it out. I'd be very interested to see how it happened."
Unless a motorist can prove that it would cause exceptional hardship for them, a total of 12 penalty points means a temporary ban from driving. The decision is made by a court.
However, if a driver escapes a ban due to these exceptional circumstances, and they then accrue more penalty points within three years, they are not entitled to appeal using the same reasons.
The data obtained by BBC West showed a total of 638 drivers in Bristol, Dorset, Gloucestershire, Somerset and Wiltshire with more than 12 points on their licences.

Its REEEEALLY simple, i know from experience back in my misspent youth, if you go over 12 points, you could get a 6 month ban for example, the points stay on your license for longer than that, so you can be back driving while still being over 12 points. Also i had an accident (not in a vehicle) and was off work for two years before i got back into work driving a delivery van, i had to go to court for offenses commited about 6 months before i got the job, so my transport manager came with me, they asked him if giving me points would cause me to lose my job, and he said once over 6 points it made no difference to the company insurance, they gave me 18 points and let me keep my license to keep me in work. they dont HAVE to ban you at 12 points, thats when it becomes an option to the court. I had 144 points on my license at one point and was still allowed to drive. Its been clean now for over 10 years before you all start on me. 
Its the wifes until it breaks down.

My licence is clean, very and has been since last month when it in on a medium wash in my jeans pocket.... 
This posting may have been helpfull, on the other hand probably not... Either way, I may have had drink when posting it in which case it's probably not as helpfull as it could have been Work safe, and remember all technical problems can be resolved with a hammer, the trick is knowing where to hit it and how big a hammer to use (I often find it may also help to have a spare bit in the shed to replace the bit you have just mullered  ) Work in Progress (or not as the case may be) I give you.... Damn! If i had known that wrinkle back in 1975 I wouldn't have grabbed an International and run off round the world. ( As an alternative to 6 months bread and water.) But then; I wouldn't have met all the people I met.
If you need something done quickly just ask a busy woman then get the f"k out of her way.

it took a real kick up the arse to get me to behave, i ended up doing 3 months for driving while disqualified after they caught me several times, that was back in the mid 90's. I got my last lot of points in about '96 so i have been good for 15 years now, and considering i have been building things like 200bhp Cortinas and V8 kit cars i think its pretty amazing i havent even had a speeding ticket.
