Either way he is Clearly telling lies. Time to Lie back. Say he admitted liability ( as he was late for work, his work may have record. If it goes that far) You only gave him contact details nothing else, this was so he could contact you in the morning with his policy number so you could report it as legally required to. When you didnt hear anything you just assumed he was an uninsured driver & as your vehicle suffered no damage you just left it. You were shocked when the letter came through the door as you were still awaiting his details...Here is my legal dept...

Unfortunately these days it seems we have a blame/claim culture in this country that just didnt exist before these 'personal injury' blood suckers arrived from the U.S. The only thing to do in ANY situation involving any kind of 'coming together' of road users (no matter who is to blame - never admit liability - or how trivial it seems) is to contact your insurance compay ASAP! Most (if not all) companies operate a 24 hour 365 days a year full time phone line and it is best to give them all of the details and let them then deal with ALL correspondence with the other party. Taking photos can help, but also get details of any independant witnesses if possible and make notes yourself as soon as possible after the accident while everthing is still fresh in your memory - every police officer will tell you that the most accurate and reliable statements of events are taken either straight away or within 12 hours. Re: insurence clame - HELP PLEASEI spoke to my insurence co. today and told them my side of the story, I also mentioned that I think hes trying to milk it and that its a fraudulent claim. When I said "Correct me if I'm wrong, but dont you have to be injured to make a personal injury claim?" the guy chuckled and said you would be suprised at what people make claims for these days, thats when I said I think hes milking it ect ect.
At the end I asked him what he was claiming for, and he said, "hes claiming for lower back pains, whiplash and pain down his right hand side" I then said he was plenty well enough to get out and yell and shout and fling his arms around at the time so I dont think any of his "injuries" were caused by the crash. He said that hes make a note of everything Ive said and that they will get back to me to keep me updated. On a up side I do have personal injury cover and legal cover, plus windscreen cover and nat. plus brakedown cover.....so you cant say I'm not covered lol I'll keep you all updated as and when I get updated, and I hope to god they (my insurence) wins the case or I'll have to sell the truck come april, meaning I wont make the anual meet, nor will I get to do most of the lanes around here as they are closed untill end of april (kick in the teeth really), and worst of all I'll have to put up with a shoddy old 3 cylinder corsa. still, least that'll have the same number of cylinders as doors, unlike the LWB fronty ![]() My 2.8 shorty - now sold, and comments here My old dti - now sold "Life should not be a journey to the grave with the intention of arriving safely in a pretty and well preserved body, but rather to skid in broadside, thoroughly used up, totally worn out, and loudly proclaiming "WOW --- What a Ride!" Re: insurence clame - HELP PLEASEIt wont matter, if they deem it too costly to go to court to argue just one point they may not win they will cut their losses and pay out as statistically that will be the cheapest option for them, whether the other guy did an illegal manoeuvre or not will be the argument and with no police evidence this can not be proved and would be kicked out by the Crown Prosecution Service anyway.
Did you say you where both insured by the same company further back in the thread? if so they will not go to court and give money to the legal system when one of the parties will be paid out, just unlucky its you that got the crappy end of the stick, its all about commercialism and how to save money at the end of the day and you are just a pawn in the chess game of insurance.. Work safe, and remember all technical problems can be resolved with a hammer, the trick is knowing where to hit it and how big a hammer to use (I often find it may also help to have a spare bit in the shed to replace the bit you have just mullered Work in Progress (or not as the case may be) I give you.... Re: insurence clame - HELP PLEASEok so as it stands now, they are sayin the because I pulled into the path of another car its my fault. and they won't budge. she did say that they would pay out but wouldn't admit liability, so it'll be a 50 50 and id loose 2 years ncb, leaving me with 1 years no claims. better than nothing I guess but by far not ideal. she did say that she hasnt received my email with my detailed right up and diagrams, so well see if she can make a better offer after reading that

Don't you have protected NCB on your policy ? if not maybe it be a good idea to get that next time If they are saying its 50/50 where does that leave you when you renew your policy ? I know they ask if you have been in an accident in the last 5 years, just wondered if your premiums will go up now? Cheers Roo

And no I dont have protected NCB, they told me when I bought the policy that you can only protect against 4 years or more, and I only had 3, soon to become 1 - bit of a kick in the teeth really Having said that, I did a quote with mods and my 1 year NCB (changed my DOB to make me 21 because by then I will be) and adrian flux rang in at about £940 ish, not too bad, only a tiny bit more than I payed for this year.
