Tough cars!

Tonight on the way to a hospital appointment, I followed a brand new VW Tiguan off a small roundabout, she had hesitated and swerved a bit so when she immediately indicated and pulled into a layby, I guessed she had taken the wrong exit (Asda was the next exit). What I didn't expect was she would try and do a U Turn right away without looking, she pulled straight out without hesitation into the main road in front of me! No chance to do anything but brake and swerve a bit, but hit her hard in the offside front wing pushing her from right angles to me to straight on. Her wing and wheel smashed, my wing slight dent and broken indicator.
Then of course she blames me and tells me I 've broken her thumb and scared her two children. I told her to call the police and did the same myself. They came and due to the damage they confirmed my story not her version which was I was speeding and overtook her. So now all the hassle of reporting it to the insurance who tell me I may have to pay more next year even if I don't claim from her and it wasn't my fault!! Oh and she lives in a million pound house!
It was once said that the Devil would never dare to cross the River Tamar into Cornwall for fear of ending up as a filling in a Cornish Pasty.

i no how or should i say i no how you feel i went and hit someone and he is claiming the good old whip lash scam then it it had taken him 4 f****** weeks to take his car to a garage just for them to tell me i did £1,200 off damage and all that he did to my frontera was a £10 number plate where the hell they came up with that i do not no now i am mad as hell it wasn"t even my fault he was in the road on the phone on a blind spot so i am going to make a big kick up over this as the insurance company aviva who are dealing with this have not done this right as during the phone call he said something or let something slip out that they just want a quick open and shut case however the bloke all so has not done something yet that the insurance bloke let slip about something he has not done when he should have done it 3 months ago at the time off the crash . so now i am going to still play the waiting game thou as this is still on going case i am not mad at this i am bloody well you get the picture thou well at least i can hold on to my frontera in till october 2013 if me insurance goes up to much i will just have to sell it & i really dont want to do that so i guess only time will tell :evil: :evil: :twisted:

Seems to be the way now , do everything you can to shift the blame ! And if there is the potential for a claim nail ppl to the wall !
I went into the back of a cleo a few year back , it was parked on a blind bend on a 60mph road. There was nobody in the car they were all at the side of the road ! ! I was cut out my car , a claim went in for 6 people's injured ! I still to this day have never seen a 6seater cleo

Book the claim through her insurance - if she's admitted liability go direct through her insurance. If your sure the claim will go through with no hassles, no need to involve your insurance company.
If you've got doubts, then let your insurance know in case you need them to fight your case. Downer on that is it will register as a no fault claim on your record, and doubtless to say your insurance company will use it as a reason to raise your premiums next renewal, even if you've got NCP.

It's exactly as your second paragraph, I have just sent them a full report and threatened to leave them, after about 20 years with no claims, if they put my premium up, you never know!

Westo - I got caught up with one of these cases a couple of years back. Somebody reversed into our Focus. When then got the soft sob story of how the young fault driver's premium would go through the roof (she drove an Astra SRi) her mother rang me up to see if I would allow the chip and scratch remover friend of hers to do the repairs on my car and not go through the insurance. That's the moment I went for safety and informed my insurance company - just in case.
Damage was a bit more involved and had it done at the local Ford main dealers. It was the body shop manager who advised me to go through the fault drivers insurance and not involve mine. All worked out OK and I didn't have to get involved with any excess payment premiums.
The only issue I had was when my renewal came through the following year, my premium went up from £300 odd to £500 odd. They tried the insurance premiums had gone up through natural increases, but did admit I had a no fault claim on my records. Found another insurance company, explained the non fault claim on my record, and got reinsured back at the sensible £300 mark.

If the accident is proven to be her fault, (You say the police confirmed your story) then don't bother with your insurance company.
Go to a garage, explain the accident to them, they fix the car and send invoice off to her insurance.
The dealers have a special section for this. My cousin recently used the Platinum network after a taxi rear-ended his missus' fiesta.

Due to bad winter a couple of year ago one of the roads I take to work was just an ice rink. there was 5 or 6 cars pilled up at the bottom of hill. nothing major,

Police and Ambulance were also there, Ambulance was there as a pedestian had been knocked down before the car accidents had happened.

I stopped ok, applied handbrake etc and I was stepping out the Fourtrak and it just starts slidding down the hill, wheels still locked up etc, just that slidy.

Anyway I got in closed door. but couldnt do nothing. probarly hit the car about 10mph. slight dent in my bumper, cracked the guys bumper who was standing at side of the road.

That was it, gave guy my details.

Didnt even claim myself as I just straightened bumper.

Now 2 years on Im still getting phone calls every other week asking if I want to claim for injuries caused by tht accident.

I keep telling them there were no f""ing injuries. it was a 10 mph accident, but they insist injuries can still happen at 10mph.

They keep telling me. ok sir we will take you off our system, do they f**k. still get them

And people wonder how their insurance goes up.

So today I get a letter from Albany Assistance Ltd telling me they have been instructed to pursue a claim against me!
What a pain in the ar*e, all this hassle for some stupid person driving into me.
