insurence clame - HELP PLEASE

Like the others have told you, get in touch with your insurance company and tell them everything, even to the claim that he is making that he was injured...
I personally think he should of given you his details like his insurance company and his name and a contact number, as he hasn't complied with the Road Traffic Law, that is required if your in an accident.. I wouldn't contact him just let your insurance company deal with the situation ...

A few years ago I was hit from behind on a roundabout and the guy who came into me was shouting 'Why did you stop'? Said because the light was red! we exchanged details and he lost the case...

Be careful mate, making a false claim for wiplash is fraud, problem is its hard to prove that you were not injured, Just out of intrest did he go to the hospital/doctor after the crash? If not he hasn't really got a leg to stand on,

i was in a an accident years ago where a guy drove into the side of my truck it took 5 years to sort but i was genuinly injured an pts as a result they generally make offers out of court small on ethen a slightly bigger one theyrarely got to court.
Be carefull how you word it an dont admit laibilty say he came out of nowwhere as you had checked the road was clear. question is why didnt he see you

just leave it all to your insurance company,
I was injured in a motor accident 4 years ago even though it was not my fault as other driver instantly admitted liability to the police and insurance company i spennt 2 weeks in hospital one of them weeks in a induced coma, my insurance/solititor have been wrapped up in red tape ever since they say it will take as along as needs be to sort out.
my passenger was paid his injury claim within 12 weeks by my insurance whitch they will claim back at a later date

The crucial question is was he coming round the roundabout behind you, or did he pull onto the roundabout as you passed the road he was coming from?

Just a small query. If the damage to his car was on his drivers door and not to the front or the rear of his car, how can he possibly have whiplash or the rest of his passengers? unless they were all very coincidentally looking to the left. Whiplash is usually caused by lateral shock, i.e. the body suddenly stops but inertia carries the head forwards or backwards depending on the impact.

One other thing to ask your insurance to check. You say it happened on a roundabout in London? Virtually every square inch of London is covered by CCTV. Maybe they can request access to CCTV footage of the junction, especially as there is claim of persons injured.

Hi Hipo, yep, A series swb's have an horrific blindspot -no doubt thats why the B's have that "shoulder" window, even the green ovals had a similar window in the swb Freelander, then Suzuki did the same with one of their 3dr models. Regards. David.

Prolly also worth pointing out that roughly 50% of your annual premium goes to cover the cost of whiplash claims, fraud and legal costs resulting in actions brought by 'specialist' law firms, who will earn about £9 for every £1 in compensation they get for you.

You may also want to contact the insurance fraud department because of all the dodgy claims going on they are looking more and more into personal injury claims if you give them all the details aswell and say you think this guy is trying to milk the system I'm more than shure they will keep their beedy eye on the case as it progresses
